Role of Betriebsrat (Works council)

Once you get appointed as Betriebsrat (Works council) for a company, your role doubles up as an expert offering help, support and guidance to the company managers and taking care of well being of the workers. As the name suggests, Betriebsrat, he is an elected representative of the workforce of a business. You provide business solutions, which could be in the form of presentations, seminars, workshops, discussions, meetings with various bodies etc. You is to bridge both the sides i.e. the management and the workers.

Bedeutung des Betriebsrates

Der Betriebsrat ist eine Vertretung der Arbeitnehmer in Betrieben. In Deutschland gibt es ein Gesetz, wann der Betriebsrat gebildet werden muss. Es müssen mindesten 5 Arbeitnehmer in einem Betrieb beschäftigt sein. Dann wird der Betriebsrat gewählt, diese vertreten die Interessen ihrer Kollegen und bestimmen mit über Entscheidungen, die im Betrieb getroffen werden sollen.

Funktion, Rechte und Kündigungsschutz

Der Betriebsrat ist die Arbeitnehmervertretung in Betrieben und Unternehmen. Er wird alle vier Jahr in der Betriebsratswahl von den Arbeitnehmern gewählt. Somit ist er auf Grundlage des Betriebsverfassungsgesetzes das gewählte Organ zur Vertretung der Interessen der Arbeitnehmer. Hierfür stehen ihm verschiedene Rechte, wie z.B. das Mitbestimmungs- und Beteiligungsrecht, zu. So kann er Arbeitnehmer über Beschlüsse der Geschäftsführung informieren, diese teilweise mitbestimmen, er kann eine beratende Funktion einnehmen, aber auch bei Einstellungen, Umgruppierungen und Versetzungen mitwirken.  Um seine Rechte in der Unternehmenspolitik effektiv einsetzen zu können, genießt der Betriebsrat einen besonderen Kündigungsschutz – dieser wird wiederum im Kündigungsschutzgesetz §15 geregelt.
